Terms of Service
Hours of Operation: 7:30 AM - 5:30 PM, Monday through Friday or by prior appointment. Deliveries where either the pickup or delivery time fall outside of normal business hours will be charged at 1.5 times the normal rate. We gladly provide service outside of normal business hours, but arrangements must be made by telephone during business hours.
Weekend Deliveries: We will provide service on Saturday and Sunday by prior telephone arrangement only. All weekend deliveries are rated at 2 times the normal business day rate.
Service Levels: MercuryPDX offers 15 Minute, 30 Minute, 1 Hour, 2 Hour and 4 Hour service levels. For deliveries that are ready when you place the order, the delivery deadline is based on the time that the order is entered. If you call in a 30 Minute rush, we will complete the job within 30 minutes of your call. If you place an order for 2 Hour service, we will complete the job within 2 hours of your call.
Timed Deliveries: Service scheduled for a specific time in the future will be priced according to the amount of time available for us to complete the job. For example, if you place an order at 9:00 AM for a pickup that will not be available until 2:15 PM and must be delivered by 3:30 PM, we will rate the job at 1 Hour service.
Service Cutoff: All service is available based solely on the time available for us to complete the delivery. If we have less than 4 hours to deliver a job, it is rated at the 2 Hour rate, etc. For same-day deliveries, service availability is determined both by MercuryPDX hours of operation and by the closing time of the delivery destination. For example, we will accept your order for 4 Hour same-day service until 1:30 PM, allowing us 4 hours until our 5:30 PM closing time to deliver the package. If the offices at the delivery point close at 5:00 PM, you would need to place the order by 1:00 PM in order to obtain the 4 Hour rate. If same-day service is not a requirement, see Deferred Deliveries below.
Deferred Deliveries: If you do not necessarily require same-day delivery, we will accept orders for service levels after the service cutoff. The delivery deadline will be calculated excluding the time between 5:00 PM and 8:00 AM. For example, if you request 4 Hour service at 3:30 PM, the due time of the delivery will be 10:30 AM of the following business day - 1.5 hours from 3:30 Pm to 5:00 PM, 2.5 hours from 8:00 AM to 10:30 AM for a total of 4 hours.
Unconditional Service Guarantee: If for any reason you are not satisfied with the service you receive from MercuryPDX, please contact the office immediately. We will correct the problem to your satisfaction - period.
Waiting Time Surcharges: If we are required to wait for a pickup or delivery, the first 7 minutes are provided at no charge. After 7 minutes, waiting time is charged at the rate of $1.00 per minute. We will advise you in person whenever possible as soon as it becomes apparent that our messenger will be required to wait.
Physical Weight Surcharges: the first 25 pounds of any delivery is included at no additional charge. Weight above 25 lbs is charged at a rate of $0.10 (10 cents) per pound, per additional pound.
Billing Terms: Invoices are created on the 1st and 16th of each month, regardless of the day of the week. Terms are net 15 days. Special arrangements are available by request to accommodate your particular A/P situation. We reserve the right to withhold both automatic and negotiated volume discounts and to accrue finance charges of 1.8% per month on any account that is more than 30 days past due.
Volume Discounts: We offer automatic volume discounts on your bi-monthly invoice - 2.5% at $100.00, 5.0% at $250.00, 7.5% at $500.00 or greater. We will negotiate discount rates above 7.5% for clients or potential clients with demonstrable high daily volume. Volume discounts, automatic or negotiated, are not available to accounts that are in excess of 30 days outstanding.
Limited Shipment Liability: As a carrier of primarily small packages and business communications, we do not utilize a bill of lading or multi-part forms that are distributed to the various parties involved. Should MercuryPDX or a courier contracted to MercuryPDX commit an error in the pickup or delivery of your package, remedy will consist of the correction of that error at our expense, credit to your account for the original service charge, or both. Any combination of remedy on the part of MercuryPDX will not exceed $100.00 in cash or value of delivery service combined. MercuryPDX will not be liable for any package in excess of $100.00. If you notify us that the value of a package exceeds $100.00, we will require you to hold MercuryPDX harmless in the event of loss or damage before we carry the package. If you do not inform MercuryPDX of the excess value of a package, we will in any case be limited to no more than $100.00 in actual damages.
Fuel Surcharging: In the event
that the costs to deliver your materials rise within an erratic per barrel
fuel economy, we will surcharge a percentage of each delivery based on a
fair and balanced schedule, available upon request. This surcharge will be
used to offset losses only, and not to generate additional revenue. The
surcharge will increase as prices rise, and decrease as they fall.
