Terms of Service for MercuryPDX, LLC Courier Services:
By using our courier services, you agree to the following terms and conditions:
- Service Availability: Our courier services are available for delivery within the Portland metropolitan area, and certain additional destinations. We reserve the right to refuse service to any location at our discretion.
- Package Restrictions: Certain items are restricted from shipment, such as hazardous materials, illegal substances, and live animals. Please refer to below for a list of restricted items. We reserve the right to refuse to ship any package that violates our restrictions.
- Delivery Times: We make every effort to ensure timely delivery of your package; however, we do not guarantee delivery times. Factors outside of our control, such as weather conditions and customs delays, may impact delivery times.
- Liability: We take all necessary precautions to ensure the safe delivery of your package; however, we are not liable for any damages or losses that occur during transit. Please ensure that your package is properly packed and labeled before shipping.
- Payment: Payment for our courier services is due at the time of shipment. We accept payment by credit card or account signup. In the event of non-payment, we reserve the right to refuse future shipments. See payment terms below.
- Privacy: We take the privacy of our customers seriously and will only use your personal information for the purpose of providing courier services. We will not share your information with third parties unless required by law. See Privacy Policy below.
- Termination: We reserve the right to terminate our courier services at any time without prior notice. In the event of termination, any packages in transit will be returned to the sender.
- Changes to Terms of Service: We reserve the right to modify these terms of service at any time. Any changes will be posted on our website and will take effect immediately.
Additional Terms and conditions:
- Operating Hours: Our business hours are from 7:30 AM to 5:00 PM, Monday through Friday, except on holidays. For deliveries outside our normal business hours, there will be a surcharge of 1.5 times the normal rate, but we will still gladly provide the service if you make prior arrangements by phone during business hours.
- Weekend Deliveries: We can provide service on Saturdays and Sundays, but only with prior arrangement by phone. Weekend deliveries are subject to higher rates, and you may call our office to request a quote.
- Payment Terms: The payment terms for courier services are flexible and can be made by prepayment using a credit card or by receiving invoices based on your account terms, regardless of the day of the week. Our standard payment terms are net 15 days. However, if you have a specific Accounts Payable situation that requires special payment arrangements, please contact our Accounting Office via email at accounting@mercurypdx.com or by phone at (503) 247-8484 during business hours. Please note that we reserve the right to withhold both automatic and negotiated volume discounts and to charge finance charges of 1.8% per month on any account that is more than 30 days past due.
- Service Levels: MercuryPDX provides various service levels, such as 15-minute, 30-minute, 1-hour, 2-hour, and 4-hour delivery, to cater to different needs. For orders that are ready when the request is made, the delivery deadline is determined by the order’s entry time. If a 30-minute rush is requested, the package will be delivered within 30 minutes of the call. Similarly, for a 2-hour service request, we will complete the job within 2 hours of the call. - Timed Deliveries: If a delivery is scheduled for a specific time in the future, the pricing will depend on the available time to complete the job. For instance, if an order is placed at 9:00 AM for a pickup that will not be ready until 2:15 PM and must be delivered by 3:30 PM, the price will be based on the 1-hour service charge.
- Service Cutoff: Our delivery service is offered based on the time available to complete the delivery. If we have less than 4 hours to deliver a job, it will be charged at the 2-hour rate. The availability of same-day service depends on MercuryPDX’s operating hours and the closing time of the delivery destination. For instance, orders for 4-hour same-day service are accepted until 1:00 PM, allowing us 4 hours to deliver the package by our 5:00 PM closing time. If the offices at the delivery point close at 4:30 PM, the order must be placed by 12:30 PM to qualify for the 4-hour rate. If same-day service is not required, customers may opt for Deferred Deliveries (see below).
- Deferred Deliveries: For customers who do not require same-day delivery, MercuryPDX offers deferred delivery options. Orders can be placed after the service cutoff, and the delivery deadline will be calculated by excluding the time between 5:00 PM and 8:00 AM. For instance, if you request 4-hour service at 3:30 PM, the delivery will be due by 10:30 AM of the following business day, which is 1.5 hours from 3:30 PM to 5:00 PM, plus 2.5 hours from 8:00 AM to 10:30 AM, for a total of 4 hours.
- Additional Charges for Waiting/Loading Time: In case our courier needs to wait for a pickup or delivery, or the volume of the package requires extensive loading time, we offer the first 7 minutes free of charge. After the initial 7 minutes, waiting/loading time will be charged at a rate of $1.00 per minute. We will inform you as soon as possible whenever we anticipate that waiting time will be required.
- Physical Weight Surcharge: Our base rate covers the first 25 pounds of any delivery. For each additional pound above 25 pounds, a weight surcharge of $0.10 (10 cents) per pound will be applied to the total cost of the delivery.
- Limited Shipment Liability: As a company specializing in the transportation of small packages and business communications, we do not use bill of lading or multi-part forms usually utilized by various involved parties. In the event of an error in the pickup or delivery of your package caused by MercuryPDX or a courier contracted to MercuryPDX, we will correct the error at no extra cost, credit your account for the original service charge, or both. However, our liability is limited to a maximum of $100.00 in cash or the combined value of the delivery service. If your package’s value exceeds $100.00, you must inform us beforehand and hold us harmless in case of loss or damage. Failure to notify us of the excess value means our liability will not exceed $100.00 in actual damages.
- Fuel Surcharge: If the cost of delivering your materials increases due to fluctuations in fuel prices, we may impose a fuel surcharge. The surcharge will be based on a fair and balanced schedule, which is available upon request. Please note that the surcharge is designed to offset our losses and not generate additional revenue. The amount of the surcharge will increase as fuel prices rise and decrease as they fall.
- Restricted items include but are not limited to:

- Illegal substances, drugs, and narcotics
- Firearms, explosives, and ammunition

- Flammable or hazardous materials, including chemicals and gases
- Biological materials, such as blood, tissues, and organs
- Perishable goods, such as specific agricultural products and live animals, with the exception of pre-arranged catering and food delivery services.
- Currency, coins, and precious metals
- Pornographic material and obscene literature
- Counterfeit items and fake currency
- Dangerous goods, such as radioactive and corrosive materials
- Valuable items, such as jewelry and artwork

Security: We take significant measures to protect the privacy and security of our clients’ information. We use industry-standard encryption and security technologies to prevent unauthorized access to our systems and data.
Data Retention: We retain client information only for as long as necessary to fulfill our contractual obligations and comply with legal requirements. Once this period is over, we securely dispose of this data.
